Baby Shaking Death Conviction Upheld

Posted Tuesday, July 8th 2014 @ 12pm  by Calvin Wright

An Oklahoma City teenager, convicted of first-degree murder in the shaking death of his nine-month-old sister, loses an appeal of his conviction.

Crystian Rivera was convicted in 2012, after prosecutors say he admitted he shook the baby because she was crying and distracting him while he played a video game.

Court records show Rivera was 13-years-old at the time of his sister's death.

Rivera's lawyers filed an appeal maintaining several reasons for a new trial, including whether trial evidence was sufficient to support conviction, and whether admission of other bad acts deprived Rivera of a fair trial.

The State Court of Criminal Appeals disagreed, and upheld Rivera's conviction.
